1. Your privacy and data protection are important to us. We only process Personal Data with your consent and we adopt reasonable measures to protect the same.

2. You acknowledge that you have read and understood the Privacy Policies of Tojino Medical Clinic, including the Privacy Notice published in the Website, and that you agree with and accept the Privacy Policies of Tojino Medical Clinic, as stated in the Website or as incorporated in this Agreement, including any update, revisions, modifications or amendments thereto.

3. In availing and using the Service and any Session, you hereby expressly consent to the processing of your Personal Data, and such consent shall remain in place unless specifically withdrawn in writing and communicated to Tojino Medical Clinic. You may exercise any of your rights as data subject. However, in case of withdrawal of your consent to process the Personal Data, you hereby acknowledge and agree that Tojino Medical Clinic will be unable to provide the Service and the Professional will be unable to participate in any Session with you. You hereby absolve Tojino Medical Clinic and the Professional from any liability arising from or connected with such inability to provide the Service or Session.

4. As provided in Section II.4, Tojino Medical Clinic may provide access to and allow the processing of your Personal Data by other data controllers/processors as it may deem necessary to render the Service. In relation thereto, Tojino Medical Clinic may engage the services of and/or interact with third parties, such as, but not limited to, affiliated companies, subsidiaries, financial advisors, affiliated third parties, and/or independent/non-affiliated third parties, vendors, and service providers, whether local or foreign, (collectively referred to as “Representatives”). In connection with the afore-mentioned, you hereby authorize Tojino Medical Clinic and/or its Representatives, as controller/processor of your Personal Data, to be your attorney-in-fact with full power and authority to:

a. Obtain, collect, examine, process, store, and share your personal information, including sensitive personal information and privileged information, or any other information that is necessary for you to avail of the Service, protect your rights and comply with your obligations with respect to the Agreement, as may be deemed appropriate by Tojino Medical Clinic. Except as otherwise stated, any information gathered relative to the authority you have given in this Agreement shall be kept in strict confidence; and

b. Disclose the abovementioned information to Tojino Medical Clinic and its Representatives for any legitimate business purpose Tojino Medical Clinic may deem appropriate, and as necessary to avail of the Service, protect your rights and comply with your obligations in the Agreement.

5. All Representatives likewise will be required to adhere to the Privacy Policies, and your Personal Data will be accessed and processed within a limited time and only as may be necessary to render the Service, protect your rights or comply with your obligations under the Agreement.

6. The processing of your Personal Data by the third-party information technology platform used in the Session shall be subject to your own agreement with such third-party, and you hereby expressly acknowledge and agree that Tojino Medical Clinic has no control whatsoever over such third-party platform and how they will process your Personal Data.

7. Tojino Medical Clinic will collect Personal Data as may be necessary in rendering the Service; as may be required for the Professionals to provide medical or healthcare services; as may be needed to comply with Laws and legal processes; comply with any legal obligation; or to prevent imminent harm to public security, safety and order.
